How can I receive my settlement payment?

If you are a Class Member, the only thing you need to do to receive your settlement payment is to fill out and return an IRS Form W-9 by September 22, 2026. You can submit the Form W-9 by filling out the form available on the Electronic Submissions tab above or by sending the hard copy enclosed with your Notice via regular mail to:

These payments will not be made unless and until the Court grants "final approval" of the settlement as fair and reasonable, and any such appeals from the Court's final approval order are completed.

What is this lawsuit about?

Under New Jersey law, employees are generally entitled to overtime premium pay for hours worked over 40 in a workweek. This overtime premium pay must be calculated at 1.5x the employee's regular rate of pay.

Plaintiff's Class Action Complaint alleged that Defendant misclassified Class Members as exempt from the overtime requirements of New Jersey law, and therefore failed to pay Class Members an overtime premium for each hour worked over 40 in a workweek, in violation of New Jersey law.

Defendant argued that it properly classified Plaintiff and Class Members as exempt from overtime requirements and argued that Defendant had no liability to Plaintiff or Class Members for any alleged unpaid overtime compensation. Defendant maintains it was not required to pay Class Members overtime compensation.

The Court has not decided the unresolved legal issue of whether Defendant properly or improperly classified Plaintiff and Class Members as exempt from overtime. By reaching a settlement, both Plaintiff and Defendant avoid the potential risks, uncertainties, and delays associated with fully litigating these legal and factual disputes.

As a Class Member, you have the following options:

1. 1 Submit IRS Form W-9 by September 22, 2026. This is the only step required to receive your settlement payment. You may submit your W-9 electronically through the Electronic Submissions tab or by mailing the hard copy to the Settlement Administrator at the address above.
2. 2 Object to the Settlement. If you believe the settlement is not fair, reasonable, or adequate, you may file a written objection with the Court. Objections must be postmarked by June 26, 2026.
3. 3 Request Exclusion (Opt Out). If you do not wish to participate in the settlement and retain your right to sue Defendant independently, you may exclude yourself. Requests for exclusion must be postmarked by June 26, 2026.
4. 4 Do Nothing. If you do not return a Form W-9 by the deadline, you will not receive a settlement payment but will still be bound by the terms of the settlement and release of claims.
